McCowen murder trial, day 10

As the prosecution began wrapping up its case Tuesday, defense attorney Robert George dropped another bombshell.

At the time of Christa Worthington's murder, Jeremy Frazier was using a cell phone registered to David Murphy, who recently had been released from state prison in Walpole after serving nine years for manslaughter.

Murphy worked with Frazier at Magnum Movers, where Worthington had kept personal belongings in storage since 1999.

Frazier, 19 at the time, told police his cell phone bill was higher than his parents were willing to cover so Murphy agreed to register the phone in his name. Murphy corroborated the story.

While there is no physical evidence linking Frazier to the murder, it is another road bump for the prosecution on a day when Asst. District Attorney Robert Welsh was expected to close his case on a strong note.

Earlier in the day, he called State Trooper Scott McCabe and Sgt. Bill Burke to testify that defendant Christopher McCowen was sober when arrested. That effort was to counter an expected attempt by George to claim McCowen was under the influence of drugs when he was interrogated afterward.

Burke also corroborated earlier testimony by Det. Christopher Mason that McCowen, during that interrogation, confessed to being at Worthington's house when she was murdered.

It was on cross-examination of Burke that Murphy's past was revealed.

Welsh also called Matthew Frazier, Jeremy's uncle, to diffuse a possibility that a black truck seen coming out of Worthington's driveway on Jan. 5, 2002, was his. He reported the truck in question was a 30,000-pound dump truck with a snow plow in front.
