The Unit is conveyed together with:
An undivided interest of 10% in the Common areas and facilities ("Common Areas") of the Condominium described in Master Deed, attributable to the Unit. An exclusive right to use the limited Common Areas appurtenant to the Unit as Described in the Master Deed, including, without limitation, the right to use basement room and other areas, as recited in Section 5.C of the Master Deed. An easement for the continuance of all encroachments by the Unit on any adjoining units or Common Elements existing as a result of construction of the Building, or which may come into existence hereafter as a result of settling or shifting of the Building or as a result of repair or restoration of the Building or of the Unit after damage or destruction or by fire or other casualty, or after a taking in condemnation or eminent domain proceeding, or by reason of an alteration or repair to the Common Elements made by or with the consent of the Trustees. An easement in common with the owners of the other units to use any pipes, wires, ducts, flues, conduits, public utility lines, and other Common Elements located in any of the other units or elsewhere in the Condominium and serving the Unit. The Grantor's right with respect to the four (4) boat moorings in the water on or bordering the Common Elements. Rights and easements in common with other Unit owners as described in the Master Deed.
Said Unit is conveyed subject to:
Easement in favor of adjoining units and in favor of the Common Elements for the continuance of all encroachments of such adjoining units or Common Elements on the Unit now existing as a result of construction of the Building, or which may come into existence hereafter as a result of settling or shifting of the building, or as a result of repair or restoration of the Building or of any adjoining unit or of the Common Elements after damage or destruction by fire or other casualty, or after a taking in condemnation or eminent domain proceedings, or by reason of an alteration or repair to the Common Elements made by or with the consent of the Trustees. An easement in favor of the other units to use the pipes, wires, ducts, flues, conduits, cables, public utility lines, and other Common Elements located in the Unit or elsewhere in the Condominium and serving such other Units. The provisions of the Unit Deed, the Master Deed, including without limitation the restrictions on use contained in Section 6 of the Master Deed, the Declaration of Trust and the Plan, as the same may be amended from time to time by instrument recorded with the Registry of Deeds, which provisions, together with any amendments thereto shall bind any person having at any time any interest or estate in the Unit, his family, servants and visitors, as though such provisions were recited and stipulated at length herein. All easement, agreements, restrictions and conditions of record, insofar, as the same are not in force and applicable. The Unit is intended for residential purpose, and related uses allowed by the Town of Truro Zoning By-Law.

Terms of Sale: These premises are being sold subject to any and all unpaid real estate taxes, water rates, municipal charges and assessments, condominium charges, expenses, costs, and assessments, if applicable, federal tax liens, partition wall rights, statutes, regulations, zoning, subdivision control, or other municipal ordinances or bylaws respecting land use, configuration, building or approval, or bylaws, statutes or ordinances regarding the presence of lead paint, asbestos or other toxic substances, sanitary codes, housing codes, tenancy, and, to the extent that they are recorded prior to the above mortgage, any easements, rights of way, restrictions, confirmation or other matters of record.
Purchaser shall also bear all state and county deeds excise tax. The deposit of $5,000.00 is to be paid in cash or bank or certified check at the time and place of the sale, with the balance of the purchase price to be paid by bank or certified check within thirty (30) days after the date of the sale, to be deposited in escrow with Guaetta and Benson, LLC, at 229 Billerica Road, Chelmsford, Massachusetts.
In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by foreclosure deed to the second highest bidder or, thereafter, to the next highest bidders, providing that said bidder shall deposit with said attorney, the amount of the required deposit as set forth herein within five (5) business days after written notice of the default of the previous highest bidder.

The Provincetown Conservation Commission will hold a public hearing and public meeting on Tuesday, September 14, 2010 at 6:30 p.m. in Room 6 at the Grace Gouveia Building, 26 Alden Street, Provincetown Massachusetts, to consider the following:
Notice of Intent Application by Town of Provincetown represented by AECOM under the Massachusetts Wetlands Protection Act (M.G.L. c. 131, s.40) and the Provincetown Wetlands Bylaw Chapter 12. The Provincetown Department of Public Works Notice of Intent with the Conservation Commission for the municipality of Provincetown, MA seeking permission to replace portions of the existing water main and extend the sewer collection system to incorporate the east end and west end of town within the Beach Point Area, along Bradford Street, and along the west end of Commercial Street. Construction activities include the installation of gravity sewers, pump stations, and force mains. The proposed project involves portions of work within the 100-foot Buffer Zone, a previously developed portion of Coastal Dune, and the 100-year Flood Plain adjacent to Provincetown Harbor (Land Subject to Coastal Storm Flowage) as protected under the Massachusetts Wetlands Protection Act (M.G.L., c. 131, s. 40) and its implementing Regulations (310 CMR 10.00), the Provincetown 50-foot Buffer Zone as protected under the Provincetown Wetlands Protection Bylaw (Chapter 12) and Provincetown Conservation Commission Local Regulations (Article 2), as well as a portion of Estimated and Priority Habitat as mapped by the Massachusetts Natural Heritage and Endangered Species Program. The majority of this project is eligible to be treated as a coastal/inland Limited Project under 310 CMR 10.24 (7)(b) and 310 CMR 10.53 (3)(d): Construction of an Underground Public Utility (Sewer Line). The project has been designed to meet the performance standards under the Massachusetts Wetlands Protection Act Regulations and no direct impacts to inland wetlands would occur. Since portions of project activities will occur within the Provincetown 50-foot Buffer Zone, this application serves to request a variance for these activities.

Pursuant to Harbor Regulation 3-2-3, The Provincetown Harbormaster's Office will be removing vessels from the town beaches in accordance with section b):
b) Any dinghy or vessel routinely (more than seven consecutive days) stored on the beach which is not permitted, or in the consideration of the Harbormaster, posses a hazard to other vessels, property, or the resource area, may be ticketed and or removed and stored or disposed of at the owner's expense. Any dinghy or vessel removed and stored, which is not claimed within 15 days is subject to disposal by the Harbormaster. Removal fees are $50 (fifty) per vessel plus towing, disposal or other costs incurred. Storage fees are $25 (twenty five) per day.
On or about September 15, 2010, any vessel on town beaches, not properly permitted, may be removed and disposed of without further notice. For questions, permits or to report a derelict vessel, please call the Harbormaster's Office at (508) 487-7030.

Provincetown Banner: September 2 and 9, 2010 ----------------------------------- LG Provincetown TOWN OF PROVINCETOWN REQUEST FOR QUALIFICATIONS CAPITAL NEEDS ASSESSMENT
The Town of Province-town is requesting proposals from qualified firms for the completion of a capital needs assessment for seventeen (17) buildings owned by the Town of Provincetown and the preparation of bid documents for certain identified repairs.
The fee for the project including all expenses required for its completion shall be negotiated, but shall not exceed $150,000.
Specifications may be obtained beginning August 30, 2010, at the temporary office of the Town Manager, 16 Jerome Smith Road, Provincetown, MA 02657, Monday through Thursday, between the hours of 8:00 A.M. and 6:00 P.M., by calling (508) 487-7002 or by e-mailing slynn@provincetown-ma.gov. Questions relative to this Request for Qualifications should be directed in writing to Sharon Lynn, Town Manager or David Guertin, Director of Department of Public Works or Russell Braun, Building Commissioner.
A non-mandatory information session shall be held at 10:00 A.M. on September 1, 2010 at the temporary Town Hall offices, 16 Jerome Smith Road, Provincetown, MA 02657. For those interested, a brief tour of the buildings to be included in the project shall immediately follow.
A signed original and 4 copies of the proposal must be submitted in a sealed envelope and clearly marked "Provincetown Capital Needs Assessment Proposal - Do Not Open" on the front. Proposals will be received until September 15, 2010, 2:00 p.m. at which time all proposals will be opened publicly. Late proposals will not be considered and faxed proposals will not be accepted. Delivery of proposals will be at the expense of the proposer. Any and all damages that may occur due to packaging, shipping or timely arrival will be the sole responsibility of the proposer. (Please note that overnight carriers do not deliver to Provincetown in the morning. If using Fed-Ex, USPS Express Mail, UPS Overnight, DSL or similar carriers, please allow two days for delivery.)
The Town of Province-town reserves the right to select the firm or individual it feels is most qualified based on the information submitted, to waive any informality, and to choose a firm or individual determined to be able to perform in the best interest of the Town. The Town of Provincetown encourages women and minority-owned businesses to submit proposals.
All proposals will be taken under consideration for award of contract at a later date. The Town Manager shall award a contract after interview and selection from short listed firms by a recommendation of the Capital Needs Assessment Committee.
